This document contains important information regarding your rights and obligations, as well as conditions, limitations, and exclusions that apply to you. Please read it carefully.

All artworks are subject to prior sale and taxes where applicable

Studio Sales website terms

The following are the terms of use for the studio sales website, which can be accessed at buy.richardparry.art. By accessing, viewing, or using the content, material, or services available on or through the Studio sales website, you indicate that you have read and understand these Studio sales website Terms, that you agree to them and that you intend to be legally bound by them. If you do not agree to these Studio sales website Terms, you are not granted permission to use the Studio sales website and must exit immediately.

1. Richard Parry Website Terms & Conditions Applicable. The Richard Parry Studio sales website and all of its content, including without limitation, all artwork, images, photographs, documentation, website, constitute Site Material under and as defined in the Website Terms. All rights and responsibilities you have with respect to the Richard Parry Website and Site Materials under the Website Terms apply to your use of the Studio sales website. Moreover, all rights and obligations of the parties with respect to the “Terms” under and as defined in the Website Terms will apply equally with respect to the Studio sales website, including, without limitation, (i) Richard Parry’s right at any time to modify, alter or update the Studio sales website Terms.
2. Privacy Policy. Use of the Studio sales website is also subject to the Richard Parry studio Privacy Policy, which is incorporated into these Studio Sales website Terms by reference.
3. Artist Intellectual Property Rights. Reproduction or redistribution of the Site Material or any portion of the Site Material is strictly prohibited without the prior written permission of Richard Parry and, as applicable, the corresponding artist or their estates or other rights holders.
4. Reports and Publications. Richard Parry reports and publications provided in the Studio sales website are provided for informational purposes only; reproduction and distribution, even for non-commercial use, is prohibited. Downloading material for any commercial use is prohibited. Such reports and publications contain the opinions of Richard Parry only. Richard Parry is not responsible for any errors or omissions in such reports and publications, and we do not guarantee the accuracy, correctness, reliability or completeness of the content. No representations or warranties of any kind are made with respect to the content of such reports and publications, express or implied. Accordingly, you should not rely upon the content of any such report as a basis for making any decisions about the Work or otherwise. For the avoidance of doubts, all rights not granted by Richard Parry are specifically reserved.
5. No Offer or Contract. Neither the Studio sales website nor any artwork, images, photographs, documentation or other materials, information, or images contained therein shall constitute an offer of sale of any artwork viewable in the Studio sales website (a “Work”), and does not constitute, nor give rise to, a contract between us with respect to the purchase of any such Work or otherwise. While I welcome any inquiries, the appearance of any Work on the Studio sales website does not constitute a representation or promise that the Work will be available for sale at any given time, and your making an inquiry about a particular Work does not constitute an offer of purchase for such Work or give rise to a contract between us with respect to the purchase of such Work or otherwise.
6. Right of Removal. I reserve the right to remove, at any time, any Work or other content, including, without limitation, any and all images, photographs, documentation or other material on or from the Studio sales website.

Exhibiting Artwork

Please follow any installation, storage or display instructions made available with the Artwork. Please don’t change the Artwork. For example, don’t interfere with the arrangement of an installation, or try to change an Artwork's original method of display (including picture framing) other than by the instructions I provide. You may enjoy my Artworks only as permitted by law, including payment of applicable export and re-export control laws, regulations and duties.

Owning my Land Art does not give you ownership of any intellectual or territorial property rights, either of the Artwork's documentation or any situation/s the Artwork happens in. These terms do not grant you the right to use or circulate any visual, audio, or written materials used in, or alongside the Artwork without written permission from myself.

Sometimes, Artworks use content that is not mine. This content is the sole responsibility of the entity/entities that made, or continue to make it available.

In connection with your purchase, I may send you occasional event announcements, catalogues, christmas cards and other information. You may opt out of this communication at any time.

Ownership of Artwork

My artworks are diverse, so sometimes additional terms or ownership requirements (including exhibition requirements) may apply. Additional terms will be supplied with the relevant Artwork and those additional terms become part of your agreement for owning those Artworks.

I grant you a personal, worldwide, royalty-free, non-assignable and exclusive license to use the Artwork as provided to you. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Artwork as provided to you, in the manner permitted by these terms. You may not copy, modify, distribute, offer for sale, sell, lease or reproduce our Artwork or any associated elements, unless you have my written permission first.

Land Art is important. Some elements in my Land Artworks may be offered under an open source license that I will make available to you, and others. There may be provisions in these open source Land Art licenses that expressly override some of the terms above.

My Warranties and Disclaimers

I produce Artworks using a commercially reasonable level of skill and care and hope that you will enjoy using them. But there are certain things that are not promised:

Other than as expressly set out in these terms or additional terms, neither Richard Parry nor his suppliers or distributors make any specific promises about artworks. For example, Richard Parry doesn’t make any commitments about the specific situation or functions of artworks, or their availability, or ability to meet your needs. All artwork is provided “as is”.

Cancellations and Returns

Since my first sale in 2006, there have been no returns.

However, should you wish to cancel a purchase after payment is made but before the artwork is shipped, please email me for a full refund. Should you wish to return an artwork after receipt, please keep the artwork in the original condition, in the original packaging (including the original delivery documents) and contact me within 14 days of it having left my studio. Return claims after this point will not be possible. Please do not return an artwork to me without first making contact. Richard Parry shall have sole discretion in determining a returned artwork's condition.

Liability for my Services

When permitted by law, Richard Parry and Richard Parry's suppliers and distributors, will not be responsible for lost profits, revenues, or data, financial losses or indirect, special, consequential, exemplary, or punitive damages.

These terms control the relationship between myself and you. They do not create any third party beneficiary rights.

If you do not comply with these terms, and I don’t take action right away, this doesn’t mean that I am giving up any rights that I may have (such as taking action in the future). If it turns out that a particular term is not enforceable, this will not affect any other terms.

Governing law and Jurisdiction

The Artwork, and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims), shall be governed by, and construed in accordance with, English law, and the parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.

Welcome to richardparry.art (“Richard Parry” or “I”). Since graduating from Goldsmiths in 2006, I have developed my artwork alongside the trust of my collaborators, clients and audiences. I endeavor to understand their interest in art, at the same time, protect their privacy. I publish this Privacy Notice to let you know how I will collect, use, and protect personal information about you.

This Notice covers information that you give me when you bid on an artwork, purchase something from me, commission an artwork, register for or attend any of my events around the world, visit my studio or website, request a printed catalogue, sign up for any of my newsletters, or publish information on richardparry.art webpages on social media accounts.

Please note that I may offer you online bidding opportunities: you may leave a bid through my own artist website. Data about you will be collected and used according to this Notice. I may also arrange for other parties to allow you to participate in sales of Richard Parry artworks from their sites. The other parties may collect data about you and your participation according to their respective privacy policies. Those other parties will transfer data about you to me to fulfill successful transactions and I may also use that data in any manner consistent with this Notice. I may make video or audio recordings of my events, exhibition spaces, and certain live events.

Who is responsible for your data?

If you transact in a private sale in the EEA or Switzerland Richard Parry will be the data controller for that data. My name and contact details will be set out in your purchase agreement, private sale agreement or invoice. If you visit richardparry.art, another Richard Parry website or use a Richard Parry app, then the data controller will be Richard Parry, a UK entity, and this Notice contains his contact details.

What is the legal basis on which I rely to process your data?

On some occasions, I processes your data with your consent (e.g., if you ask mey to send you information about upcoming events).

On other occasions, I processes your data when I need to do this to fulfill a contract with you (e.g., for billing purposes) or where I am required to do this by law (e.g., where I have to fulfill anti-money laundering requirements). If it is mandatory for you to provide data for these purposes, I will make this clear at the time and will also explain what will happen if you do not provide the data (e.g., that I will not be able to process a transaction).

About Richard Parry

Glasgow, 2020

Richard Parry was born in Hull in 1983 and graduated from Goldsmiths College in 2006 with a joint honours degree in Fine Art and History of Art. In 2006 he started a studio in London for the purposes of contemporary art. From 2005 to 2014 he worked at Christie's auctioneers and coordinated New Dome exhibitions with artists of his generation. In 2010, he inaugurated his first Museum exhibition of counterfeit Readymades, at the National Gallery of Zimbabwe during Harare International Festival of Art.

In fourteen years Richard's Land Art has developed into a constellation of fifteen works across Europe, Africa and The Americas, with a Land Art crypto commons launched in 2021. His painting studio, hosted by the Lewisham Art House cooperative hosts events and welcomes guests. Since 2009, studio paintings have been painted and distributed at multiple points throughout each year.

Between 2016-18, Richard taught at the University of Arts Berlin, involving the collective purchase of some land in the Czech Republic, in common with students of The Academy of Arts, Architecture and Design in Prague. He was awarded the Emerging Artist Award at the Whitechapel gallery in 2011. Richard is Lay Representative for the Lewisham and Greenwich NHS Trust Art committee and a member of the Lewisham Art House artist co-operative.

By accessing, viewing, or using the content, material, or services available on or through the Studio sales website, you indicate that you have read and understand these Studio sales website Terms, that you agree to them and that you intend to be legally bound by them. If you do not agree to these Studio sales website Terms, you are not granted permission to use the Studio sales website and must exit immediately.
  
  1. Richard Parry Website Terms & Conditions Applicable. The Richard Parry Studio sales website and all of its content, including without limitation, all artwork, images, photographs, documentation, website, constitute Site Material under and as defined in the Website Terms. All rights and responsibilities you have with respect to the Richard Parry Website and Site Materials under the Website Terms apply to your use of the Studio sales website. Moreover, all rights and obligations of the parties with respect to the “Terms” under and as defined in the Website Terms will apply equally with respect to the Studio sales website, including, without limitation, (i) Richard Parry’s right at any time to modify, alter or update the Studio sales website Terms.
  2. Privacy Policy. Use of the Studio sales website is also subject to the Richard Parry studio Privacy Policy, which is incorporated into these Studio Sales website Terms by reference.
  3. Artist Intellectual Property Rights. Reproduction or redistribution of the Site Material or any portion of the Site Material is strictly prohibited without the prior written permission of Richard Parry and, as applicable, the corresponding artist or their estates or other rights holders.
  4. Reports and Publications. Richard Parry reports and publications provided in the Studio sales website are provided for informational purposes only; reproduction and distribution, even for non-commercial use, is prohibited. Downloading material for any commercial use is prohibited. Such reports and publications contain the opinions of Richard Parry only. Richard Parry is not responsible for any errors or omissions in such reports and publications, and we do not guarantee the accuracy, correctness, reliability or completeness of the content. No representations or warranties of any kind are made with respect to the content of such reports and publications, express or implied. Accordingly, you should not rely upon the content of any such report as a basis for making any decisions about the Work or otherwise.   6. Right of Removal. I reserve the right to remove, at any time, any Work or other content, including, without limitation, any and all images, photographs, documentation or other material on or from the Studio sales website.
  
  Exhibiting Artwork
  
  Please follow any installation, storage or display instructions made available with the Artwork. Please don’t change the Artwork. For example, don’t interfere with the arrangement of an installation, or try to change an Artwork's original method of display (including picture framing) other than by the instructions I provide. You may enjoy my Artworks only as permitted by law, including payment of applicable export and re-export control laws, regulations and duties.
  
  Owning my Land Art does not give you ownership of any intellectual or territorial property rights, either of the Artwork's documentation or any situation/s the Artwork happens in. These terms do not grant you the right to use or circulate any visual, audio, or written materials used in, or alongside the Artwork without written permission from myself.
  
  Sometimes, Artworks use content that is not mine. This content is the sole responsibility of the entity/entities that made, or continue to make it available.
  
  In connection with your purchase, I may send you occasional event announcements, catalogues, christmas cards and other information. You may opt out of this communication at any time.
  
  Ownership of Artwork
  
  My artworks are diverse, so sometimes additional terms or ownership requirements (including exhibition requirements) may apply. Additional terms will be supplied with the relevant Artwork and those additional terms become part of your agreement for owning those Artworks.
  
  I grant you a personal, worldwide, royalty-free, non-assignable and exclusive license to use the Artwork as provided to you. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Artwork as provided to you, in the manner permitted by these terms. You may not copy, modify, distribute, offer for sale, sell, lease or reproduce our Artwork or any associated elements, unless you have my written permission first.
  
  Land Art is important. Some elements in my Land Artworks may be offered under an open source license that I will make available to you, and others. There may be provisions in these open source Land Art licenses that expressly override some of the terms above.
  
  My Warranties and Disclaimers
  
  I produce Artworks using a commercially reasonable level of skill and care and hope that you will enjoy using them. But there are certain things that are not promised:
  
  Other than as expressly set out in these terms or additional terms, neither Richard Parry nor his suppliers or distributors make any specific promises about artworks. For example, Richard Parry doesn’t make any commitments about the specific situation or functions of artworks, or their availability, or ability to meet your needs. All artwork is provided “as is”.
  
  Cancellations and Returns
  
  Since my first sale in 2006, there have been no returns.
  
  However, should you wish to cancel a purchase after payment is made but before the artwork is shipped, please email me for a full refund. Should you wish to return an artwork after receipt, please keep the artwork in the original condition, in the original packaging (including the original delivery documents) and contact me within 14 days of it having left my studio. Return claims after this point will not be possible. Please do not return an artwork to me without first making contact. Richard Parry shall have sole discretion in determining a returned artwork's condition.
  
  Liability for my Services
  
  When permitted by law, Richard Parry and Richard Parry's suppliers and distributors, will not be responsible for lost profits, revenues, or data, financial losses or indirect, special, consequential, exemplary, or punitive damages.
  
  These terms control the relationship between myself and you. They do not create any third party beneficiary rights.
  
  If you do not comply with these terms, and I don’t take action right away, this doesn’t mean that I am giving up any rights that I may have (such as taking action in the future). If it turns out that a particular term is not enforceable, this will not affect any other terms.
  
  Governing law and Jurisdiction
  
  The Artwork, and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims), shall be governed by, and construed in accordance with, English law, and the parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.

  Welcome to richardparry.art (“Richard Parry” or “I”). Since graduating from Goldsmiths in 2006, I have developed my artwork alongside the trust of my collaborators, clients and audiences. I endeavor to understand their interest in art, at the same time, protect their privacy. I publish this Privacy Notice to let you know how I will collect, use, and protect personal information about you.
  
  This Notice covers information that you give me when you bid on an artwork, purchase something from me, commission an artwork, register for or attend any of my events around the world, visit my studio or website, request a printed catalogue, sign up for any of my newsletters, or publish information on richardparry.art webpages on social media accounts.
  
  Please note that I may offer you online bidding opportunities: you may leave a bid through my own artist website. Data about you will be collected and used according to this Notice. I may also arrange for other parties to allow you to participate in sales of Richard Parry artworks from their sites. The other parties may collect data about you and your participation according to their respective privacy policies. Those other parties will transfer data about you to me to fulfill successful transactions and I may also use that data in any manner consistent with this Notice.   If you transact in a private sale in the EEA or Switzerland Richard Parry will be the data controller for that data. My name and contact details will be set out in your purchase agreement, private sale agreement or invoice. If you visit richardparry.art, another Richard Parry website or use a Richard Parry app, then the data controller will be Richard Parry, a UK entity, and this Notice contains his contact details.
  
  What is the legal basis on which I rely to process your data?
  
  On some occasions, I processes your data with your consent (e.g., if you ask mey to send you information about upcoming events).

  Richard Parry was born in Hull in 1983 and graduated from Goldsmiths College in 2006 with a joint honours degree in Fine Art and History of Art. In 2006 he started a studio in London for the purposes of contemporary art. From 2005 to 2014 he worked at Christie's auctioneers and coordinated New Dome exhibitions with artists of his generation. In 2010, he inaugurated his first Museum exhibition of counterfeit readymade art, at the National Gallery of Zimbabwe during Harare International Festival of Art.
  
  In fourteen years Richard's Land Art has developed into a constellation of fifteen works across Europe, Africa and The Americas, with an interconnected and complimentary Land Art crypto commons launched in 2021 on the Ethereum blockchain. His painting studio, located with the Lewisham Art House artist cooperative in the former Deptford Central Library, regularly hosts events and welcomes guests. Since 2009, decentralised painting projects have been developed and made available for distribution at multiple points throughout each year.
  
  Between 2016-18, Richard taught at the University of Arts Berlin, involving the collective purchase of some land in the Czech Republic, in common with students of The Academy of Arts, Architecture and Design in Prague. He awarded the Emerging Artist Award at the Whitechapel gallery in 2011. Richard is Lay Representative for the Lewisham and Greenwich NHS Trust Art committee and a member of the Lewisham Art House artist co-operative.
